This section describes the procedural pathway from community deliberation to formal governance change. It applies to all four governance options and explains how any governance direction would be implemented in practice.
Ophir's Home Rule Charter can be amended through two pathways, both requiring approval by a community-wide vote.
Pathway 1: GA Ordinance. The General Assembly may initiate a charter amendment by passing an ordinance with a two-thirds vote of members present at a regular or special meeting. If approved, the proposed amendment is placed on the next available municipal election ballot and requires approval by a majority of registered Ophir voters.
Pathway 2: Registered Voter Petition. Registered Ophir voters may initiate a charter amendment through petition. If a sufficient number of registered voter signatures as defined by Colorado law is collected, the proposed amendment is placed on the ballot and requires approval by a majority of registered voters.
In both pathways, no amendment takes effect unless approved by a majority of registered voters at a community election. (C.R.S. Section 31-2-210; Colorado Constitution, Article XX)
